Supervisors meeting held June 21, 2006 at

ANNOUNCEMENTS:
· Bruce Groff and Dave Reese completed a course on âHeavy Equipment Safetyâ at Willow Street Vo-Tech.
· All three supervisors will attend NIMS Training on July 25 at the Public Safety Building.
· An Official Map seminar will be set up by Robert Heckrote for Pequea Township Planning Commission.
· Thursday, June 15 at 7 p.m. A Public Meeting on SS Fisher request for a Permit Modification to Stockpile Steel was requested and held by DEP at Pequea Township.
· The Tire Recycling Program was successful again this year. Thank you to the volunteers who helped that day. Thank you to the residents who brought in tires.
PUBLIC COMMENT: Public comment on items included on the agenda will be taken at the appropriate time. Public comment on items not included on the agenda will be taken at the end of the business meeting. Please come to the podium and limit your comments to five minutes.
MINUTES OF THE PREVIOUS MEETING: Robert Race moved to approve the May 17, 2006 minutes as printed. Bruce Groff seconded the motion. All voted in favor, none opposed.
SECRETARY TREASURER REPORT: A copy of the bill list and a financial report has been provided on the front table. Robert Race moved to approve checks #4399 through #4445 of the General Fund, #581 of the Street Light Fund, and checks #1592 through #1602 of the Recreation Fund. Virginia Brady seconded the motion. All voted in favor, none opposed.
RIGHT OF WAY ORDINANCE & RESOLUTION
The proposed ordinance was advertised in the Lancaster Newspapers on June 9, 2006. Proof of publication is entered for the record. The proposed ordinance defining, permitting and regulating use of the public right-of-way; establishing requirements for filing a bond and obtaining a permit; establishing priority among competing users; providing for the establishment of fees; requiring detailed plans of proposed construction; requiring compliance with applicable laws and regulations; authorizing actions by Pequea Township for violations thereof; and providing penalties for violations will be considered this evening.
A proposed resolution establishing and adopting a fee for using and occupying the township rights of way as referred to in Ordinance is also being considered.
There were no questions or comments from the floor. No written comments were received.
Robert Race moved to adopt Ordinance #144-2006. Virginia Brady seconded the motion. All voted in favor, none opposed.
Robert Race moved to adopt Resolution #306-2006. Bruce Groff seconded the motion. All voted in favor, none opposed.
AWARD CONTRACTS FOR SEAL COATING
BID OPENING: JUNE 19, 2006 AT 10 AM
Present at bid opening was Patsy Davis, Sec-Treasurer and Chad Sweigart, McMinnâs Asphalt Co., Inc. Bid proposals were advertised in Lancaster Newspapers, Inc. for the second request for seal coating. Rejection of the paving bid resulted in the decision to bid for additional seal coating of various roads and also seal coating of the lot at Pequea Township Municipal Building. Only one bid was received from McMinnâs Asphalt Co. Inc. as follows:
Seal Coating Various Roads: $1.02 per SY = $115,594.56
Seal Coating Lot Municipal Building: $1.20 per SY + $6,159.60
Virginia Brady asked if there was a reason for the difference in the SY costs of $1.02 and $1.20. Pat Davis stated no reason was given at bid opening. Bruce Groff will check with the contractor.
Robert Race moved to award the contract for Seal Coat of various roads at $1.02 to McMinnâs Asphalt Co., Inc. Bruce Groff seconded the motion. All voted in favor, none opposed.
Robert Race moved to award the contract for Seal Coat of the lot at the municipal building at $1.20 per SY to McMinnâs Asphalt Co., Inc. Bruce Groff seconded the motion. All voted in favor, none opposed.
Bruce Groff moved to set aside $6,000 from the General Fund to complete the above contract for seal coat of various roads. Robert Race seconded the motion. All voted in favor, none opposed.
OLD BUSINESS:
- Conestoga River Watershed Ordinance â DEP no longer reviews proposed ordinances. Virginia Brady spoke with the township solicitor regarding this. Virginia Brady moved to table this item of business. The motion was seconded by Robert Race. All voted in favor, none opposed.
- Mt. Hope School Road â Bruce Groff stated the township engineer plans have been received. He and the engineer will again meet with Henry King and Jay Reynolds. Several thousand dollars has been saved with the new plans.
- PPL Substation â Bruce Groff stated that DCNR and the County has approved the acceptance of $50,000 in lieu of replacement land. Certain conditions for use of the money have been agreed upon. Bruce Groff has asked the Park & Recreation Board for certain projects to be submitted for approval.
- Neighborhood Development Zoning Ordinance Amendment â A discussion was held by the supervisors on the Pequea Township Planning Commissionâs failure to review the entire proposed ordinance at the June meeting. This review will be continued in July. Robert Race moved to authorize the township solicitor to proceed with advertising for a hearing July 19, 2006. Virginia Brady seconded the motion. All voted in favor, none opposed.
- Re-Zoning Map â Robert Race moved to authorize the township solicitor to proceed with advertising for a hearing July 19. Bruce Groff seconded the motion. All voted in favor, none opposed.
- The Privy, Hauler and License Agreement for the Radcliff Amish Parochial School have been received. Robert Race moved to accept the agreements. Virginia Brady seconded the motion. All voted in favor, none opposed.
- The RADON Challenge has been dismissed by the challengers. Lancaster Newspapers had a very good article on this subject. PSATS is now using our ordinance as a sample for other municipalities.
NEW BUSINESS:
- A letter requesting a study has been written by the Supervisors to PA Dept of Transportation regarding the number of traffic accidents occurring at Long Lane and Marticville Road. Resident complaints have been received in addition to a report from Southern Regional Police Dept. on the accidents. Rep. Scott Boyd has also requested a traffic study at this location due to resident concerns.
- A letter has been written by the Supervisors to Lancaster County Planning Commission requesting that the Countyâs Growth Management Plan be changed to revise the Urban Growth Boundary for Pequea Township.
- Robert Race moved to authorize William C. Crosswell, township solicitor, to accept service of the Petition for Judicial Tax Sale of the property located at 242 Marticville Road. Bruce Groff seconded the motion. All voted in favor, none opposed.
DEPARTMENTAL REPORTS
- Road Crew â Work report on file. Bruce Groff added that two employees are performing above what has been expected of them. Bruce Groff moved to increase Paul Frymyerâs wage to $16.00 per hour. Robert Race seconded the motion. All voted in favor, none opposed. Bruce Groff moved to increase Nathan Frymyerâs wage to $8.00 per hour. Robert Race seconded the motion. All voted in favor, none opposed. Both increases will start the next payroll period.
- Zoning/Code Officer â Work report on file. Wes Bruckno reported that he addressed all the vehicle complaints in Manchester and Westwood Village except for one. He is still working on that. Complaints in Millwood Village have been addressed. Martin Harnish asked if this would apply to Pfeifferâs Garage. It is overflowing with junk vehicles. Wes Bruckno replied that Pfeifferâs Garage has been grandfathered. He moves vehicles and submits a list to the township. Virginia Brady noted that she saw basketball nets appearing on streets in Manchester Village. Wes Bruckno said that he cannot prohibit them as long as on private property. The police will need to address this if on public right-of-way. Robert Race noted that we may need to post the township property with âNo Skateboardingâ. A problem with a youth developed on Election Day and has continued.
- Legal Liaison â Bruce Groff noted that he spoke with the solicitor on the Brenneman Road overpass. Also regarding the township roads being used by PPL trucks hauling dirt from the construction site.
- Legal Liaison â Virginia Brady spoke with the township solicitor on the proposed Re-Zoning Map, the Neighborhood Development Ordinance, and the Conestoga Water Shed Ordinance.
ADVISORY BOARD REPORTS
- Pequea Township Planning Commission â The meeting was held June 1, 2006. The minutes are on file.
- Pequea Township Environmental Advisory Council â The meeting was held June 8, 2006. The minutes are on file.
- Lancaster Inter-Municipal Advisory Council â Virginia Brady did not attend June 14. She reported that the NIMS Training was discussed.
PUBLIC COMMENT:
- Martin Harnish was present with a number of issues. He requested the drain at Millwood Road and West Willow Road be repaired. Robert Race noted that problem was reported to PennDot a number of times.
- Martin Harnish reported that the road banks are not being mowed. Hydraulic fluid was left on a township roadway from a broken tractor. Bruce Groff reported that the mowing is being done but they did have trouble with the tractors and mowers needing repairs.
- Martin Harnish reported that three fire company members attended training at the Susquehanna Truck Services seminar.
- Martin Harnish requested an explanation of the procedure for the proposed re-zoning map hearing to be held July 19. Wes Bruckno stated that copies of the proposed zoning map showing the changes and the present zoning map are available for public review at any time. A decision will be made at the hearing to either make all or some of the proposed changes. Wes noted that there were several public meetings held when adopting the Comp Plan which shows the proposed changes to be made.
- Virginia Brady asked if the supervisors want a representative from Gannett Fleming to be at the hearing July 19. Wes Bruckno stated he could explain the proposed zoning changes and it would not be necessary for someone to attend unless the board had other reasons. It was decided not to request someone to attend.
- John Miller was present to ask if burning in a trash barrel is allowed in Pequea Township. His neighbor is burning any time, even after dark. Wes Bruckno stated he felt the law does not prohibit burning in a trash barrel but that it is allowed only between sunrise and sunset. The supervisors asked Wes to check on this.
Having no further business the meeting was adjourned at approximately 8:30 p.m.
