MINUTES OF THE PREVIOUS MEETING: Robert Race moved to approve the February 21, 2007 minutes as printed. Bruce Groff seconded the motion. All voted in favor, none opposed.
SECRETARY TREASURER REPORT: Robert Race moved to approve checks #4889 to 4963 of the General Fund, checks #1674 to 1678 of the Recreation fund, and check #591 of the Street Light Fund. Bruce Groff seconded the motion. All voted in favor, none opposed.
SOUTHERN REGIONAL POLICE REPORT FEBRUARY- The Feb. report and annual 2006 report is on the front table.
OLD BUSINESS:
- Brenneman Road RR Bridge – Virginia Brady reported that Mr. Brookmeyer has signed off the bridge. The Township solicitor, Bob Sisko has sent letters to the adjacent landowners to reply by March 30.
- SS Fisher Landfill Permit Modification – No updates.
- PPL Substation Access Agreement – No updates.
- Amendments to Cable Ordinance – Robert Race moved that the township solicitor be authorized and directed to advertise consideration and enactment of a proposed ordinance to amend the Pequea Township Cable System Ordinance, Ordinance No. 112-1999, as previously amended by Ordinance No. 121-2001, to revise regulations relating to the operation of cable systems in Pequea Township. Virginia Brady seconded the motion. All voted in favor, none opposed.
- Boundary Trees SS Fisher – Wes Bruckno sent a letter to Mr. Fisher but has not received a reply.
- Planning Commission Member Replacement – No resume received. The Supervisors will review the ones on file.
- Elam & Betsie Stoltzfus – PADOT-HOP/E&S Control Plan – Bruce Groff met with Rep. Scott Boyd. Mr. Boyd will speak to PADOT about reducing the size of the pipe to 18” rather than 24” to help reduce the cost. Stoltzfus’s engineer, Bob Murphy, said that PADOT would like a comment from the Supervisors on the maintenance agreement of the Stoltzfus drainage improvements. The Supervisors will draft a letter that they are aware of what is being proposed but will not take any responsibility for the maintenance of the drainage structures on the Stoltzfus property or PADOT right-of-ways.
- Magee Kyper, Pequea Elementary School has signed the proper paperwork and the educational field trip will be held at the Silver Mine Park May 10, 2007.
NEW BUSINESS:
- Pequea Township EAC – Robert Race moved to accept the resignation of Mike Draude. Bruce Groff seconded the motion. All voted in favor, none opposed.
- Pequea Township Park & Recreation Board - Robert Race moved to accept the verbal resignation of Donald Homsher from the Park & Recreation Board. Bruce Groff seconded the motion. All voted in favor, none opposed. The Board met March 14, 2007 to organize. They will continue to meet the second Wednesday each month at 7:00 p.m. The public is invited to attend. A member is needed to replace Mr. Homsher. Bruce Groff moved to appoint Phil Chmiel. Robert Race seconded the motion. A vote was taken and Virginia Brady voted no, opposed. The motion carried.
- Summerfield Development – Robert Race moved to approve the request for a waiver of the Lancaster County Planning Commission three meeting delay for review of Summerfield. Bruce Groff seconded the motion. All voted in favor, none opposed.
- Vehicle Accident 272S & W. Penn Grant Rd has destroyed the traffic signal control box. Traffic & Control Solutions has prepared a cost for replacement and temporary repairs that have been done to date. The person causing the accident has State Farm Insurance. The billings have been submitted to State Farm for approval and payment. Robert Race moved to accept the proposal in the amount of $13793.75. Bruce Groff seconded the motion. All voted in favor, none opposed. The Roadmaster is planning to install guide rail or some other type of barrier to protect the new controller box.
- LEASE – 2007 Cannon Copier – Robert Race moved to approve the lease of the 2007 Cannon copier as presented on the Colony Products proposal subject to approval of the office staff following a demonstration. Bruce Groff seconded the motion. All voted in favor, none opposed. There is no penalty for cancellation of the existing copier lease.
- Snow Removal Ordinance - Parked Vehicles – Bruce Groff commented that it is a problem having parked cars along the roadways in the developments when plowing snow. The sample ordinances from PSATS will be given to the Township solicitor for enactment by Pequea Township.
- Park Moratorium - Robert Race moved to lift the moratorium placed on work to be done at the Silver Mine Park as of March 21, 2007. Bruce Groff seconded the motion. All voted in favor, none opposed.
- Purchase New Park Mower – Robert Race moved to purchase one Model TC34DA New Holland Diesel Tractor – Four Wheel Drive from PA STATE CONTRACT 2420-01 in the amount of $17,786.62 and an installation cost for the mower deck and canopy of $450.00 to be paid from the Recreation Fund. Bruce Groff seconded the motion. All voted in favor, none opposed. Virginia Brady questioned where the mower will be used at the park. Bruce Groff stated that the Park & Recreation Board is reviewing the Chesapeake Bay Agreement and the present mowing plan. They will recommend a new mowing plan for 2007 season.
- Mowing Recreation Fields – Two proposals were received for 2007.
Hodson’s Lawn Care Service $171.00 per mowing of 9 acres
Sandra Bachman – Pine Cone Hill Lawn & Garden $143.10 per mowing of 9 acres
Bruce Groff moved to accept the proposal for mowing of the park recreation fields from Hodson’s Lawn Care Service at $171.00 per mowing. Robert Race seconded the motion. All voted in favor, none opposed.
DEPARTMENTAL REPORTS

Legal Liaison – Virginia Brady reported updates under business.
ADVISORY BOARD REPORTS
- Pequea Township Planning Commission – Meeting March 1, 2007 – No quorum.
- Pequea Township Environmental Advisory Council – Meeting March 8, 2007 – No quorum.
- Pequea Township Park & Recreation Board – Meeting March 14, 2007 at 7 pm. Chairman, Harry Lehman was present and gave a review of what was done at their first meeting. He requested volunteers to help at the park and left a signup sheet on the front table. He reported speaking to Dave Wise of the Chesapeake Bay Foundation. They will have a course of action to present to the Supervisors at the April meeting. He invited the public to attend their meetings. They would appreciate the input from the residents.
- Lancaster Inter-Municipal Committee – Virginia Brady reported that LIMC met at Pequea Township March 14 at 7:30 a.m. The speaker gave a presentation on creating a “County Health Department”. County Commissioner’s Shellenberger and Henderson were present.
PUBLIC COMMENTS:
- Tina Virgil reported that she still did not receive a notice regarding the Landfill Permit Modification. Bruce Groff said he reported this to both John Orin and Randy Wise of DEP. It was said that only adjacent property owners need to receive the notification. The photos of the orange water were given to DEP. An onsite inspection was done regarding the orange water in the stream on March 12 which showed a clear stream and the report was sent to Pequea Township. Tina stated the stream was reported clear on the DEP report because of heavy rain and snow melting into the stream before the inspection.
- J. Martin Harnish stated that a merger report from the fire company was given to the township secretary within the last month. He requested to see that report. Pat Davis stated the she did not know of any fire company merger report received at the Township office. The only reports received from the fire companies were the annual financial reports for 2006. Pat Davis stated that if there was such a report it should be available at the fire company office.
