Minutes of the Pequea Township Board of
Supervisors meeting held May 17, 2006 at
7:30 p.m. at the Pequea Township Building,
1028 Millwood Road, Willow Street, PA
Present at the meeting were: BOARD OF SUPERVISORS

ANNOUNCEMENTS:
- Tuesday, May 16 primary election resulted in 453 voters for Pequea Township. Both Bruce Groff and Lois Aument, Republican Committee persons won their positions.
- Executive sessions were held by the Board of Supervisors on May 10, 2006 and May 15, 2006 on personnel.
- Virginia Brady attended the PSATS convention April 24, 2006 through April 26, 2006.
PUBLIC COMMENT: Public comment on items included on the agenda will be taken at the appropriate time. Public comment on items not included on the agenda will be taken at the end of the business meeting. Please come to the podium and limit your comments to five minutes.
MINUTES OF THE PREVIOUS MEETING: Robert Race moved to approve the April 19, 2006 minutes as printed. Bruce Groff seconded the motion. All voted in favor, none opposed.
SECRETARY TREASURER REPORT: A copy of the bill list and a financial report has been provided on the front table. Robert Race moved to approve checks #4349 through #4398 of the General Fund, check #580 of the Street Light Fund, checks 1581 thorough #1591 of the Recreation Fund. Virginia Brady seconded the motion. All voted in favor, none opposed.
CONSIDERATION OF RESOLUTIONS PARK AND RECREATION PLAN AND FEES IN LIEU OF DEDICATION
The first resolution adopts a park and recreation plan and the second resolution establishes a fee in lieu of dedication in the amount of $1500 per residential lot or dwelling unit.
There were no questions from the floor. No questions from the Board.
Robert Race moved to adopt Resolution No. 304-2006 the Park Resolution and Resolution No. 305-2006 the Fee Resolution. Virginia Brady seconded the motion. All voted in favor, none opposed.
AWARDING OF CONTRACTS FOR SEAL COATING AND PAVING
Advertisement for bids appeared in Lancaster Newspapers on April 14 and April 21, 2006. Bids were received and opened Monday, May 15, 2006 at 10:00 a.m. at Pequea Township building for State Fund projects. Present at the bid opening were: Secretary, Pat Davis - Road Supervisor, Bruce Groff- Road Worker, Paul Frymyer-Karen Runkle, McMinn’s Asphalt Co., Inc. and Andy Leacock.
Bids for seal coating were received from:
McMinn’s Asphalt Co., Inc. at .93 cents per SY for a total of $39,115.80
Stewart & Tate, Inc. at .9845 cents per SY for a total of $41,408.07
Bids for paving were received from:
McMinn’s Asphalt Co., Inc. at $56.21 per Ton for a total of $87,125.50
Robert Race moved to award the contract for seal coating to McMinn’s Asphalt Co., Inc. in the amount of .93 cents per SY. Bruce Groff seconded the motion. All voted in favor, none opposed.
Discussion was held on the bid received for paving. Bruce Groff commented that the unit price of $56.21 per ton is much higher than anticipated. He recommended rejecting that bid and using more seal coating this year.
Robert Race moved to reject the bids for paving due to the high costs per unit price. Bruce Groff seconded the motion. All voted in favor, none opposed.
SOUTHERN REGIONAL POLICE REPORT for April – Officer John Mitchner was present and read the April Police Report. Copies are on the front table.
Police Commissioner, Bruce Groff – Southern Regional Police participated in “Operation Maestro” that resulted in the breakup of a $10 million cocaine drug ring in Lancaster County. He commented that he is very proud of our Department. Acknowledgement was received from the Pennsylvania Attorney General’s Office for our Department’s participation in the operation.
Manor Township would like to begin discussion on the possibility of joining the Southern Regional Police Department. Robert Race moved to agree that Pequea Township participate in a feasibility study with Conestoga Township and Manor Township for the possibility of Manor Township joining the Regional Department. Bruce Groff seconded the motion. All voted in favor, none opposed.
OLD BUSINESS:
- Conestoga River Watershed Ordinance – no update.
- ROW Telecommunication Ordinance – no update.
- Mt. Hope School Rd Stormwater Project – Bruce Groff commented that he is waiting for the engineer specifications for bidding the project. There is $40,000.00 in the budget for this project.
- Creek Rd Abandonment – Bruce Groff commented that proceedings will be taken to abandon Creek Road when Mt. Hope School Road is completed.
- PPL Substation – Bruce Groff commented that a letter has been prepared for DCNR and County of Lancaster to request acceptance of the $50,000 in lieu of replacement land from PP&L. He would like this letter to be reviewed by the township solicitor before sending. Secondly, a four-way stop should be installed at Run Valley Rd and Silver Mine Rd due to the heavy equipment for construction that will be used by PP&L. Conestoga Township has agreed to install the additional two stop signs, making this intersection a four-way stop.
- Neighborhood Development Proposed Ordinance to Amend PT Zoning Ordinance – will be reviewed by LCPC Monday, May 22.
- Re-Zoning Map for Pequea Township – the proposed Ordinance was reviewed by the PTPC and recommendation was made for adoption. No recommendation was received from LCPC as yet. Virginia Brady checked and LCPC lost the letter of request sent by the township solicitor on April 12, 2006. A second letter was sent and LCPC scheduled review on June 12, 2006.
- Privy, Hauler and License Agreements for the Radcliff Amish Parochial School – no update.
- SS Fisher Application for Permit Modification – the Twp Solicitor contacted DEP and a public meeting is scheduled for June 15, 2006 at 7:00 p.m. at the Pequea Township building.
- Traffic Solutions just replaced a preemption card at the traffic signal Long Lane & Marticville Rd. A new proposal was received for the same traffic signal to replace the controller. The cost quoted is $3260.00. Due to numerous problems with the preemption devices Robert Race moved to research services from another company. Bruce Groff seconded the motion. All voted in favor, none opposed.
NEW BUSINESS:
- Phil Coolman, Conestoga Area Historical Society was present to ask for volunteers. They would like to see people serving on the board from all townships in the area. Please call him at 871-9235, the Society at 872-1699 or the Pres. Lester Hauck at 872-7631 if you would like to volunteer.
- Tire Recycling Program for 2006 – The EAC recommended holding a Tire Recycling Program on June 10, 2006. This was approved by the Supervisors and a notice was put in the Pequea Pulse which is presently at the printer.
- Robert Race moved to hire Gloria Chmiel as receptionist clerk at the hourly rate of $13.50. Virginia Brady seconded the motion. All voted in favor, none opposed.
- Robert Race moved to hire David Reese as road worker at the hourly rate of $13.50. Bruce Groff seconded the motion. Virginia Brady commented that she requested a copy of the paperwork containing questions and evaluations used to hire Mr. Reese from Bruce Groff and she did not receive that. She wanted the information before voting this evening. She did receive that information from Patsy Davis on hiring a receptionist-clerk. The vote was taken with Robert Race and Bruce Groff voting yes. Virginia Brady voted no, opposed.
DEPARTMENTAL REPORTS:
- Road Crew – work report on file. Bruce Groff added that work will be started on W. Boehm and Baumgardner Rd stormwater project May 22. A gradall will be rented for $5,500.00. It will also be used for some work at the park. He is waiting for a general permit from LCCD to begin work on replacing the culvert on Shiprock Road. Dr. Peterson asked when something will be done on Shultz Road with the stormwater. Bruce Groff commented that the water there is coming from the fields of the property owner. He will contact Lancaster County Conservation District to work with the owner to stop the water run-off.
- Zoning/Code Officer – work report on file.
- Legal Liaison – Bruce Groff reported talking with the solicitor on the PP&L proposal in regards to DCNR and the County of Lancaster.
- Legal Liaison – Virginia Brady reported talking with the solicitor on the Comcast proposal and the Neighborhood Development ordinance.
ADVISORY BOARD REPORTS:
- Pequea Township Planning Commission – meeting held May 4, 2006.
- Pequea Township Environmental Advisory Council – meeting held May 11, 2006.
- Lancaster Inter-Municipal Advisory Council – Virginia Brady reported that the Regional Comp Plan is still being discussed. Also discussed was the Red Rose Transit.
PUBLIC COMMENT:
- Bruce Groff commented that Christ Fisher did an excellent job on the construction for barn repairs at the park.
- Virginia Brady commented that the Supervisors received two unsigned letters of complaints; one from Millwood Village and one from Manchester Village. Both have numerous complaints that if had been called into the office could have been directed to the proper persons for answers. With unsigned written complaints there is no way to contact the complainant to resolve the issues. Both letters have been given to Wes Bruckno.
