May 2009 Supervisors Minutes

Minutes of the Pequea Township Board of Supervisors meeting held May 20, 2009 at

7:00 p.m. at the Pequea Township Building, 1028 Millwood Road, Willow Street, Pa.

 

Present at the meeting were:            BOARD OF SUPERVISORS

ANNOUNCEMENTS:

  • Thank you to the Pequea Township Park & Recreation Board for a second Silver Mine Park Community Days event and to all the volunteers who helped again this year.  Thanks to all who participated and to those who contributed funds to make this possible.
  • Bruce Groff added this thanks to all the volunteers.  Special thanks to Harry Lehman, who chaired the event, he did an outstanding job; and the Park & Recreation Board for a well planned and executed event; Phil Chmiel, Park employee, who kept things cleaned up; John Coolidge, who gave tours of the Silver Mine, which was a great hit; and the Native American Dancers, who were also talked about quite often.
  • Bruce Groff congratulated Harry Lehman and Jay Reynolds for their winning the primary election seats for Supervisor.
  • Joseph Terry thanked everyone involved for the Community Day events.

 

MINUTES OF THE PREVIOUS MEETING: Copies of the April 15, 2009 minutes are on the table.  Virginia Brady moved to approve the minutes as printed.  Bruce Groff seconded the motion.  All voted in favor, none opposed.

SECRETARY TREASURER REPORT:   A copy of the bill list and financial report is on the table.  Virginia Brady moved to approve checks #6295 through #6352 of the General Fund, checks #1934 through #1940 of the Recreation Fund, check #615 of the Street Light Fund, checks #49 through #56 of the Park Donation Fund, check #1100 of the Traffic Signal Fund, and check #328 of the State Highway Aid Fund.  Bruce Groff seconded the motion.  All voted in favor, none opposed.

OLD BUSINESS:

  1. Amendments to the Pequea Township Zoning Ordinance -  LCPC review recommendations to the proposed Steep Slope and Karst Hazard amendment were reviewed by  Pequea Township Planning Commission (PTPC) on  May 7, 2009.  Discussion was held regarding the comments of the PTPC; should the amendments wait to be added in a possible Subdivision and Land Development Ordinance that is presently being reviewed or should the amendments be acted upon now.  Virginia Brady moved that the zoning amendments be folded into that Subdivision and Land Development Ordinance (SALDO) as discussed.  Bruce Groff seconded the motion.  Joseph Terry commented that he felt it would be beneficial to pass the zoning amendments now as the possible SALDO is at best several months away from being done. .  Bruce Groff then withdrew his second.  The motion died.  Bruce Groff said he felt the decision should be tabled and township engineer should look at the proposed amendments.  Virginia Brady asked Bruce Groff if that was a motion he just made? He said yes.  Virginia Brady seconded the motion. No vote was taken on that motion.  Virginia Brady moved to strike all previous motions.  Joseph Terry seconded the motion.  All voted in favor, none opposed.  Joseph Terry moved to approve the Karst and Steep Slope amendments as they are currently written.  Bruce Groff seconded the motion. All voted in favor, none opposed.
  2.  Heatherfield – The developer has corrected all deficiencies.
  3. Summerfield Pumping Station– SLSA/DEP – Bruce Groff addressed a question from DEP on the position of Pequea Township for the developer to either upgrade the existing pump station on W. Penn Grant Rd. or build a new pump station for the Summerfield development.  Bruce Groff moved to write a letter to DEP supporting the design of upgrading the existing pumping station, primarily for the safety of the residents living down there.   Joe Terry commented that he felt it was not the position of the Supervisors to make that recommendation.  The motion died for lack of a second.  Mr. Groff stated he will send a letter on his own.

NEW BUSINESS:

  1. Aaron K. Smucker – A subdivision is proposed at 2964 Shiprock Road of one 10.645 acre building lot from the existing 74.29 acres.  The lot is located solely in West Lampeter Township.  Virginia Brady moved to waive the requirements for plan processing and transfer the authority to review, process and record the plan to West Lampeter Township.  Joseph Terry seconded the motion.  All voted in favor, none opposed.
  2. Aaron K. Smucker –  Virginia Brady moved to approve the Sewage Planning Module by Resolution #59 for Plan Revision for Land Development for Aaron K. Smucker.  Bruce Groff seconded the motion.  All voted in favor, none opposed. 
  3. ASA- Virginia Brady moved to approve the request by Clifford L. & Nancy J. Charles to include 101.8 acres located at 2227 New Danville Pike in the Pequea Township Ag Security Area.  Bruce Groff seconded the motion.  All voted in favor, none opposed.   
  4. Bid Opening May 4, 2009 – Virginia Brady moved to reject all bids received and opened on May 4, 2009 for the MS-944 Road Project due to incorrect wording for reclamation on the advertisement and bid proposal.  Joseph Terry seconded the motion.  All voted in favor, none opposed.  Virginia Brady moved to ratify and confirm the new solicitation of bids for the MS-944 Road Project as re-bid with proper wording to mill road surface 2.5” + or – with Township to haul milling off site. Bruce Groff seconded the motion.  All voted in favor, none opposed. Prevailing Wage Act 442 applies. Bids will be opened on June 8, 2009 at 10:00 am. and awarding will be done June 17, 2009 at 7:00 p.m.
  5. Act 32 LCTCB Resolution  - Virginia Brady moved to adopt Resolution #329-2009.  Bruce Groff seconded the motion.  All voted in favor, none opposed.
  6. Pequea Pulse Newsletter – Bruce Groff moved to have all three Supervisors read the Pequea Pulse newsletter before printing and all are in agreement with the articles.  Joseph Terry seconded the motion.  All voted in favor, none opposed. 
  7. Bruce Groff requested approval to purchase a new roller for $9,900.00 from the State Highway Aid Fund.  No bidding is required for less than $10,000.00.  Three cost quotes were obtained as required.  The trade-in of the old roller brings the cost to $9,900.00.  Purchase has been approved by the PaDot representative.  Supervisors requested more information before approving the purchase.  They agreed to set a special meeting if necessary.

DEPARTMENTAL REPORTS:

Roadcrew - Work report on file.

Zoning/Code Officer – Work report on file.  Wes Bruckno reported an enforcement issue. Virginia Brady moved to send the enforcement letter as proposed by the zoning officer.  Joseph Terry seconded the motion. All voted in favor, none opposed.

Legal Liaison – Virginia Brady reported speaking with the solicitor twice.

Southern Regional Police Dept. – Work reports and Police Commission meeting minutes are available on the table.  April 2009 is not yet available.  The secretary has contacted Chief Fiorill.

ADVISORY BOARD REPORTS:

     Minutes of the advisory board’s are available on the table.

Pequea Township Planning Commission – Meeting held May 7, 2009

Pequea Township EAC – No meeting in May 2009.  Joseph Terry moved to have Patsy Davis compile answers to the questions asked on the April EAC minutes.  Virginia Brady seconded the motion.  All voted in favor, none opposed.

Pequea Township Park & Recreation Board – Meeting held May 13, 2009.  Harry Lehman thanked the Board of Supervisors for their support; the members of the Park & Recreation Board, the volunteers and all who supported Community Days.  There were a total of 50 events this year.  $1,827.45 was raised in donations. 

Heather Hegelgans was present to show her plan for a playground and request permission to start the initial planning.  Joseph Terry moved to allow the initial planning.  Virginia Brady seconded the motion.  All voted in favor, none opposed.

Scout, Caleb Bollinger would like to proceed with a flag burning project as his Life Project at the Park on Flag Day, June 14.  Virginia Brady moved to allow the project.  Joseph Terry seconded the motion.  All voted in favor, none opposed.

Lancaster Inter-Municipal Committee – Virginia Brady reported no meeting.

Lancaster County Planning Commission – Virginia Brady - Neighborhoods of Lancaster is on the County website and will be on our read board.  LCPC completed the Green Infrastructure Element of the Envision document.  It is on the website and will be here also.

The Bay Journal, by the Chesapeake Bay Alliance, will be on the read board.

PUBLIC COMMENT:

  • Jackie Johns reported the Southern Regional police reports are from March; none is there for April.
  • Amy Reis was present to let everyone know about the compliments on the Silver Mine Park she heard at Community Days.
  • John Hickey commented on the Pequea Township news article in Sunday News May 17. 
  • June Reynolds wanted an apology from Virginia Brady on behalf of her son.
  • Tim Gilbert asked for Virginia Brady’s resignation.
  • Supervisor, Joseph Terry attended an April meeting of the Southern Lancaster County Inter-Municipal Council made of thirteen municipalities in the southern end.  They are looking at insurance through Benecon, with Highmark PPO Blue, to obtain lower costs for insurance through a larger group.  There is a copy of an agreement to join the group which he passed along to the other Supervisors.

 

MEETING ADJOURNED:  Having no further business the meeting was adjourned at approximately 8:45 p.m.
