Minutes of the Pequea Township Board of Supervisors meeting held April 15, 2009 at

ANNOUNCEMENTS:
- The Conestoga Area Historical Society is featuring Pequea Township this year. At the opening reception Thursday, April 16 there will be an 8 p.m. Gallery talk in Gundel Hall The History & Geology of the Pequea Silver Mine by Dr. Charles Scharnberger, retired professor Millersville University. E.M. Herr has sponsored the exhibit. It continues Saturdays and Sundays April 18 through December 13, 2009 from 1-4 p.m.
GUEST SPEAKER
- A Special presentation was given by Chris Haefner. He is the author of a book titled “The Silver! Mines!”
MINUTES OF THE PREVIOUS MEETING: Copies of the March 18, 2009 minutes are on the table. Virginia Brady moved to approve the March 18, 2009 minutes as printed with the correction to #2 under Old Business adding the word “present” after most residents. Bruce Groff seconded the motion. All voted in favor, none opposed.
SECRETARY TREASURER REPORT: A copy of the bill list and financial report is on the table. Virginia Brady moved to approve checks #6226 through #6294 of the General Fund, checks #1920 through #1933 of the Recreation Fund, check #614 of the Street Light Fund, checks #46 through #48 of the Park Donation Fund, and check #1099 of the Traffic Signal Fund. Joseph Terry seconded the motion. All voted in favor, none opposed.
OLD BUSINESS:
- Bruce Groff moved to appoint Robert Porterfield to the Pequea Township Planning Commission for the term to expire January 2010. There was no second to his motion. Virginia Brady moved to appoint Fred Witmer to the Pequea Township Planning Commission for the term to expire January 2010. Joseph Terry seconded the motion. All voted in favor, none opposed.
- Discussed was the use of the township hallway on Election Day. Joseph Terry moved to not allow distribution of political info in the hallway. There was no second to his motion. Bruce Groff moved to not allow any furniture in the hallway during the primary or general elections. Joseph Terry seconded the motion. All voted in favor, none opposed.
- Discussed were amendments to the Pequea Township Zoning Ordinance. The amendments now have been reviewed by the Pequea Township Planning Commission and the Lancaster County Planning Commission. Joseph Terry moved to authorize the Township Solicitor to proceed with advertising for a Public Hearing. There was no second to the motion. Virginia Brady moved to table any action until the Pequea Township Planning Commission reviews the recommendations made by the Lancaster County Planning Commission. Bruce Groff seconded the motion. All voted in favor, none opposed.
- Shultz Road 25 mph – Virginia Brady moved to leave the speed limit at 35 mph on Shultz Road due to minimal housing and police enforcement issues. Bruce Groff seconded the motion. All voted in favor, none opposed.
- Heatherfield 18 Month Maintenance Guarantee – Virginia Brady moved to act on the notice to demand payment to Pequea Township for the sum of $43,350.00 and certify that this demand is made because of the failure of Parkway Development Corp. C/O Keystone Custom Homes to correct deficiencies noted in storm drainage facilities in the development known as Heatherfield. Bruce Groff seconded the motion. All voted in favor, none opposed.
NEW BUSINESS:
- Steel Fab Enterprises, Inc.- Letter of Credit – Virginia Brady moved to reduce the amount of the Letter of Credit for Steel Fab Enterprises to $5,000.00 on recommendation by the Township Engineer following an inspection of the required improvements. Bruce Groff seconded the motion. All voted in favor, none opposed.
- Virginia Brady moved to approve Troop 105 Mother/Son Camp Out requested May 8, 2009 at Silver Mine Park. Joseph Terry seconded the motion. All voted in favor, none opposed.
- Virginia Brady moved to approve the distribution of the Lancaster County Free Prescription Discount cards from our Pequea Township office. Joseph Terry seconded the motion. All voted in favor, none opposed.
DEPARTMENTAL REPORTS:
Roadcrew - Work report on file.
Zoning/Code Officer – Work report on file.
Legal Liaison – Virginia Brady had no business to report.
Southern Regional Police Dept. – Work report and Police Commission meeting minutes are available on the table. In addition is the 2008 Annual Report. Officer Robert Fedor was present to give the monthly police report.
ADVISORY BOARD REPORTS:
Minutes of the advisory board’s are available on the table.
Pequea Township Planning Commission – Meeting April 2, 2009.
Pequea Township EAC – Chairperson, MaryAnn Robins gave a report of their Meeting held April 14, 2009. The Act 537 Plan update draft was reviewed. Member, John Hickey added that they did vote at that meeting to drop the 537 Plan Update entirely. Ms. Robins added that several inconsistencies were found in the documents provided to her that were completed by Gannett Fleming. Her findings follow other Pequea Township committee reviews also stating inconsistencies. The minutes contain questions to the Supervisors regarding costs for the 537 Plan Update. Bruce Groff moved to drop the 537 Plan Update. Joseph Terry seconded the motion. When the vote was taken Bruce Groff and Joseph Terry voted yes. The motion carried. Virginia Brady did not vote.
Pequea Township Park & Recreation Board – Meeting April 8, 2009 Chairman, Harry Lehman added a thank you to Robert Porterfield for constructing the handicap fishing pier at the Silver Mine Park.
Lancaster Inter-Municipal Committee – Virginia Brady reported that action is needed from Pequea Township regarding a proposed Body Art Ordinance by LIMC. Virginia Brady moved to not participate in the joint LIMC Body Art Ordinance. Joseph Terry seconded the motion. All voted in favor, none opposed. May 28 dinner meeting will be held at the new Mariott. Greenscapes was discussed at the April meeting.
Lancaster County Planning Commission – No report.
PUBLIC COMMENT:
- Resident, Russ Kauffman reported road safety concerns on W. Boehm’s Road; shrubbery needs trimmed at the corner and the gutter on the left side is very deep. He also reported police enforcement issues; people are running the stop sign pulling out onto Route 272 and there was a grey truck pulling a wagon with no safety chains. These problems will be addressed.
MEETING ADJOURNED: Having no further business the meeting was adjourned at approximately 9:05 p.m.
